Art Purchase Terms

01Artwork

Each artwork is offered subject to availability and prior sale, reservation or withdrawal.

The applicable invoice and Certificate of Authenticity will identify the artwork, artist, medium, dimensions, year where known and other relevant information.

02Images and Appearance

RedBee makes reasonable efforts to accurately photograph and describe artwork.

Actual colors, textures, details, scale and appearance may differ from digital representations because of photography, lighting, displays, devices, browsers and the inherent characteristics of original artwork.

03Pricing and Payment

The applicable purchase price will be confirmed by RedBee before completion of the transaction.

Payment must be made using a payment method accepted by RedBee.

RedBee may require cleared funds before releasing or shipping artwork.

04Taxes, Customs and Duties

Unless expressly stated otherwise in writing, the purchase price excludes applicable sales, use, value-added, import, customs, brokerage or similar taxes, duties and governmental charges.

Where RedBee is required by law to collect sales, use or similar tax, the applicable amount will be added to the purchase price and separately stated on the invoice or other transaction record.

The purchaser is responsible for any taxes, customs duties, import charges, brokerage fees or similar governmental charges that RedBee is not legally required to collect.

05Shipping and Insurance

Unless otherwise stated in writing before purchase, the confirmed purchase price includes standard shipping and transit insurance to the agreed delivery address.

Purchasers remain responsible for applicable taxes, customs duties, brokerage fees and any exceptional, expedited or specialized delivery charges disclosed and agreed before purchase.

The purchaser must provide accurate delivery information and reasonably cooperate with any customs, shipping, insurance or delivery requirements.

Any delivery date or transit time provided by RedBee is an estimate unless expressly confirmed otherwise in writing.

06Delivery and Inspection

Purchasers should inspect artwork promptly upon delivery.

Any apparent shipping damage should be documented immediately, including photographs of the artwork, packaging and shipping materials and reported to RedBee promptly so that applicable carrier or insurance procedures may be followed.

Purchasers should retain original packaging while any shipping or insurance claim is pending.

07Certificate of Authenticity

Original artwork sold through the RedBee Art Initiative will be accompanied by an artist-signed Certificate of Authenticity, unless expressly stated otherwise in writing before the transaction.

The Certificate of Authenticity should be retained with the artwork as part of its ownership and provenance documentation.

08Physical Ownership and Copyright

Purchase of physical artwork transfers ownership of the physical artwork according to the applicable transaction documents.

Unless expressly agreed otherwise in writing, purchase does not transfer copyright, reproduction rights, licensing rights, merchandising rights, digital rights or any other intellectual-property rights associated with the artwork.

No artwork may be reproduced, commercially exploited, licensed, digitized for commercial purposes or used for merchandising or promotional purposes without authorization from the applicable rights holder.

09Impact Allocation

Ten percent (10%) of gross proceeds from every artwork sold through the RedBee Art Initiative is allocated to RedBee’s humanitarian initiatives.

Amounts collected solely as sales or use tax, customs duties, import charges or similar governmental charges are not considered artwork proceeds for purposes of this allocation.

This allocation is made by RedBee and does not constitute a charitable donation made by the purchaser. RedBee makes no representation that the purchaser is entitled to a charitable tax deduction as a result of the purchase.

10Artwork Returns & Refunds

We want collectors to feel confident when acquiring original artwork through RedBee.

Unless otherwise stated at the time of sale, a purchaser may request the return of an eligible artwork by notifying RedBee in writing within fourteen (14) calendar days of confirmed delivery.

To qualify for a return, the artwork must be returned in the same condition in which it was received, together with any accompanying documentation, certificates and where reasonably possible its original protective packaging.

Artwork must not have been altered, damaged, modified, reframed, restored or otherwise changed after delivery.

For returns based solely on a purchaser’s change of mind, RedBee will coordinate or approve appropriate return transportation and insurance. The purchaser is responsible for the reasonable cost of return shipping, handling and insurance. These costs may be deducted from the amount refunded.

Upon safe receipt and inspection of the returned artwork, RedBee will refund the purchase price and any applicable sales tax collected on the refunded amount, to the extent required by applicable law, to the original payment method less any applicable return shipping, handling or insurance costs for which the purchaser is responsible.

If an artwork arrives damaged, is materially inconsistent with its description or an error attributable to RedBee has occurred, the purchaser must contact RedBee promptly. In such circumstances, RedBee will arrange the appropriate resolution and where a return is required will bear the reasonable return shipping and insurance costs and issue the applicable refund upon return of the artwork.

Returns requested after the fourteen (14) day return period may be declined except where otherwise required by applicable law.

Purchasers should not independently ship a return without first contacting RedBee and receiving return instructions. RedBee is not responsible for loss or damage resulting from unauthorized or inadequately insured return shipments.

Nothing in this policy limits any rights or remedies that cannot lawfully be excluded or limited under applicable law.

11Force Majeure

RedBee shall not be responsible, to the extent permitted by law, for delay or failure caused by circumstances reasonably beyond its control, including carrier disruption, customs delays, governmental actions, natural disasters, war, civil disturbance, infrastructure failures or comparable events.

12Governing Documents

The applicable invoice, purchase confirmation, Certificate of Authenticity, these Art Purchase Terms and any separately executed written agreement may collectively govern an artwork transaction.

In the event of a conflict, a specifically negotiated and executed written agreement will control to the extent of the conflict.

13Governing Law

These Art Purchase Terms and artwork transactions with RedBee are governed by the laws of the District of Columbia without regard to conflict-of-laws principles except to the extent applicable law provides a purchaser with rights that cannot lawfully be waived or limited.
